Wondering if you’re entitled to receive fracture or broken bone compensation?
If your fractured bone injury was the result of someone else’s negligence, or they failed in their duty of care, you may be able to make a fractured bone claim.
Fractured Bone Injury Compensation Claims
Fractures are a fairly common reason for hospital admission. Some of these are inevitable accidents, while others may be due to debilitating conditions like osteoporosis.
Some, however, result from avoidable accidents where the injured party is blameless. If that sounds familiar, you need to talk to The Compensation Experts, as our advisors can help.

What is a Fractured Bone Claim?
If you have suffered a fractured or broken bone, due to another party’s error or negligence, you could be entitled to compensation. Broken bones can occur in many ways including:
- Playground accidents
- Being moved incorrectly in hospital or a nursing home
- At work, such as in a construction accident
- Wet floor accidents
- Cable accidents (tripping over cables)
- Warehouse accidents (for example, tripping over items that fall off broken shelves)
To give your fractured bone claim the best chance of success, it is important to engage with a personal injury lawyer who understands and specialises in these types of claims.
What’s the Difference Between a Fracture and a Break?
The words fracture, break or crack may be used to refer to a broken bone. These terms all mean the same thing.
Understanding the severity of your fracture or break is important for your claim, so try and get as much information from your doctor as possible.
Some fractures may require surgery, to set and correct the bone’s placement and you might suffer scarring if the bone punctures the skin. You may also need bone grafts or additional treatments such as physiotherapy.
Children, whose bones are softer, may suffer a bowing fracture, where the bone bends painfully but does not break. Older patients, or those with more fragile bones, may suffer from a comminuted fracture where the bone breaks into several pieces.
Types of Bone Breaks
There are multiple different types of bone breaks and fractures. But, some of the most common injuries include:
- Broken hips (in fact, around 77,000 hip fractures are treated with surgery per year in the UK)
- Broken arms
- Fractured ankle
- Broken wrist
- Fractured skull
- Broken foot
- Broken toes
- Fractured vertebrae
- Broken leg
- Fractured tailbone
- Broken ribs
- Broken elbow
- Fractured thumbs/fingers
- Fractured jaw
If you have suffered any type of fracture or bone break, you may be entitled to receive compensation.
Broken Bone Compensation Amounts
We work with lawyers who have extensive experience in handling fractured bone injury compensation claims and will actively pursue the best possible outcome for your claim.
Broken bone compensation amounts for fractures and personal injury varies according to the severity of your injury, and the impact it has had on your daily life.
The circumstances around every claim are unique, so your personal injury solicitor will treat you as an individual.
Below are some examples of how much compensation you could receive for a bone break or fracture. These figures are based on the Judicial College Guidelines – 17th edition. It’s important to remember that every claim is different, with individual circumstances that need to be considered to accurately determine the payout.
| Type of injury | Compensation amounts |
| Broken wrist | £4,310 – £73,050 |
| Severe finger fractures | Up to £44,840 |
| Simple fracture of the femur | £11,120 – £17,180 |
| Leg fractures, which include the knee joint, causing significant problems | £63,610 – £85,100 |
| Severe fractures to the hip or pelvis | £64,070 – £159,770 |
| Simple forearm fractures | £8,060 – £23,430 |
| Severe ankle injury (causing permanent walking problems) | £38,210 – £61,090 |
| Fractured clavicle | £6,280 – £14,940 |
Is There a Time Limit For Broken Bone Claims?
In general, a claim would need to be made within three years from when you suffered your fracture or bone break injury.
You can make a claim on behalf of a child until they reach the age of 18, and then they have until their 21st birthday to make a claim themselves.
If you don’t claim within these time limits, your case might become statute-barred – meaning, it won’t be processed and you’re unlikely to receive any compensation.
There are some exceptions to the time limit, so please get in touch to confirm whether you have a claim.
Upfront Payment, or No Win No Fee?
Many of the law firms we partner with will take on your claim on a No Win No Fee* basis, to take the financial risk out of fractured bone injury compensation claims.
If your fractured bone claim is unsuccessful, you do not have to pay any legal fees.
Fractured bone injury compensation claims can be lengthy and expensive but choosing a No Win No Fee agreement will ensure you are not penalised financially if your claim is unsuccessful.
*Typically, customers pay 25% including VAT of the compensation amount that is recovered by our third-party law firms, although this is subject to your individual circumstances and the actual fee may be more or less than this. Termination fees may apply if you do not keep to the terms of the agreement.
