A Guide to Personal Injury Settlements

If you have been hurt in an accident that wasn’t your fault and you’re looking to claim compensation for personal injury, then here is everything you need to know about the process. From finding a personal injury lawyer, to knowing what you may be able to claim for, and when you can expect to receive your payment.

Who Can Claim Compensation?

There are several criteria you need to meet to be able to claim compensation for damages. The first is that you have genuinely been injured within the last three years. Only having an accident is not sufficient – you also need to prove that you were physically hurt as a result.

The second criteria is that your accident was not purely due to chance – someone was at fault. It may have been accidental, deliberate or because they were negligent, but for you to be eligible for compensation you need to demonstrate that the another party was responsible.

The final requirement you need to fulfil to raise a personal injury claim is that you need to be at least 18 years old and considered to have the mental capacity to start the legal process. So if you are a minor, or a court rules your mental capacity is impaired, a close relative may make a claim on your behalf with any compensation held in a trust for you.

Types of Claims?

At The Compensation Experts we support clients with all types of personal injury claims. For example:

  • Road Traffic Accidents (including motorcycle, bicycle, and pedestrian)
  • Accident at work and industrial illness claims
  • Slips, trips, and falls
  • Body injuries, including sporting and criminal injuries
  • Construction and building site industries
  • Burns and poisoning
  • Accidents abroad, either while travelling for business or pleasure
  • Military accidents
  • Transport injuries
  • Injuries in a public space

We can assist even if you were partly to blame. We help you obtain compensation which will then give you the ability to recover and move forward after your accident.

What Can you Claim Compensation For?

The majority of your compensation will be for pain and suffering your injury causes. This amount will depend on the severity of your injury, the effect it has on your life, and whether it will cause any lasting damage.

The rest of your compensation payment will be to cover any expenses you have as the result of your injury. These can include but are not limited to:

  • Reasonable private medical care, like physiotherapy or counselling
  • Travel expenses to medical appointments, or to work if you are unable to commute via your usual method
  • Prescriptions and other medication
  • Lost income while you are recovering
  • Predicted lost income, including pension and projected promotions, if you are not able to continue along your expected career path.
