What Can I Receive Compensation For?

When personal injury experts discuss compensation, we are referring to two main types: general damages and special damages.

Compensation for general damages is a single payment made in acknowledgement of the impact an accident has had on your life, including pain and physical disability. The amount will vary depending on the nature and severity of your injuries and their lasting effects, for example in the case of a model who was left with facial scarring after a car accident, or a construction worker who suffered lasting mobility issues after an accident on site.

Special damages cover extra costs you have incurred as the result of your accident. These can include reasonable medical expenses such as obtaining private medical care to avoid long NHS waiting lists, travel expenses, paying for medication, and replacement or repair of clothing and personal items.

How Much Compensation Will I Receive?

The Judicial Studies Board publishes guidelines for personal injury cases based on what has been paid previously. However, even these guidelines can have a significant variation which is why it pays to hire a personal injury lawyer who specialises in your type of claim. For example, a victim of a facial injury which leaves little to no physical damage may be awarded £1,200, while those with a severe injury causing permanent disfigurement and scarring may be entitled to more than £70,000.

Can I Make a Personal Injury Claim?

If you were hurt in an accident that was caused by another party’s negligence or mistake, you might be entitled to claim compensation for damages even if you were partly to blame. There are instances where you may be able to raise a claim on behalf of another person, for example, parents who apply for their children, an adult claiming for an elderly parent or relative, or a carer or guardian claiming for a person who is mentally incapacitated. Compensation in these cases is held in trust to be used for the care of the victim.

It is also possible to claim on behalf of the estate of someone who died as the result of an accident, or who has died after contracting a workplace-related illness like mesothelioma. In this instance, the money is paid either to the deceased person’s estate or their dependents.

How Long Do I Have to Make a Personal Injury Claim?

You have three years from the date of your accident to make a personal injury claim, or from the date your injury was determined to have been caused by your accident, whichever is the most recent. If you were a minor at the time of your accident, then you have until your 21st birthday to either settle a claim or to bring court proceedings against the responsible party if you have not been able to come to an agreement out of court.

Although three years may seem like a long time we always advise clients to contact The Compensation Experts at their earliest opportunity, even if they are not yet certain they are going to pursue a claim. It becomes harder to obtain quality evidence as time passes, and applications involving severe or complicated injuries can take more than two years.

How Long Does a Personal Injury Claim Take?

As with compensation payments, it is not possible to predict how long a claim will take as there are many variables involved. Your lawyer will do their best to compile the evidence you need to prove your injury and its impact in the shortest possible time. If the other party acknowledges liability and agrees to pay reasonable compensation, your claim may take 4-6 months. If, however, they deny responsibility or refuse to offer a fair amount of money to cover damages, then your lawyer may recommend you challenge their stance in court. This can mean your claim could take several years from start to finish.
