Compensation Claim Cost Payment Funding
The cost of making a claim for personal injury compensation is something clients want to know before they commit to anything. We understand; the idea of hiring a personal injury lawyer is likely to be an expense you have never had to consider. But the good news is that there are a variety of options that make it affordable for everyone.
Ways to Pay for a Compensation Claim
The cost of a compensation claim includes not only your lawyer’s fees but also incidental charges. These include the expense of an independent medical report, travelling expenses, if your claim goes to court, and barrister’s fees. Some personal injury solicitors charge by the hour while others may offer a flat fee for a particular type of compensation claim. The three most important ways people afford their legal costs are through a conditional fee agreement, with an insurance payment or, in a small number of claims, with assistance from their trade union.
A conditional fee agreement is also known as No Win No Fee* and it is one of the services The Compensation Experts offer our clients. With a No Win No Fee agreement, you do not need to pay the cost of your legal fees if your claim is unsuccessful, though you may still be liable for some of the incidental expenses of your case. If you win, your solicitor will take part of your compensation payment to cover their fee.
If you do not meet the criteria for a conditional agreement, or you prefer to pay your legal expenses separately and keep the full amount of compensation for yourself, you might choose to cover your legal costs with an insurance policy. Some clients already have legal protection as part of their home or car insurance, while others take out After the Event (ATE) insurance instead.
If you have an accident at work, then you may be able to access legal support through a trade union you are a member of.
How Do Solicitors Get Paid?
When lawyers offer clients a conditional agreement contract, they only do so when they have looked into the claim and believe there is a chance it will succeed. They take the risk that, if their client doesn’t get paid compensation, they lose the billable hours they have spent on the case.
If your compensation claim is successful, then the bulk of your lawyer’s costs will be paid for by the insurance company of the losing party. Your lawyer’s success fee is from your compensation payment as a percentage rate you agreed with them at the start of the claim, and this amount is usually around 25%.
